Terms of Service

Welcome to GrokCred. These Terms of Service ("Terms") govern your access to and use of the GrokCred website, applications, and services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for all activity that occurs under your account.
2. Description of the Service
The Service lets you design, issue, and verify Open Badges 2.0–compliant digital credentials. You may upload recipient information (such as names and email addresses) so we can issue credentials and deliver them on your behalf.
3. Your content and recipient data
You retain all rights to the badge designs, criteria, recipient lists, and other content you submit ("Your Content"). By submitting Your Content, you grant us a worldwide, royalty-free license to host, display, transmit, and process it solely as needed to operate the Service.
You represent and warrant that:
- You have the legal right and any required consent to submit recipient personal data (including names and email addresses) and to issue credentials to those recipients.
- Your Content does not infringe the rights of any third party.
- You will comply with all applicable laws, including data-protection laws such as the GDPR and CCPA, when collecting, uploading, and using recipient data.
4. Acceptable use
You agree not to:
- Use the Service to send spam or unsolicited bulk messages.
- Issue credentials that are false, misleading, or fraudulent.
- Attempt to access, probe, or interfere with parts of the Service you are not authorized to use.
- Reverse engineer or copy any part of the Service except as permitted by law.
- Use the Service to violate any law or the rights of others.
5. Privacy
Our Privacy Policy explains how we collect, use, and protect personal information. By using the Service, you also agree to the Privacy Policy.
6. Third-party services
The Service relies on third-party providers (for example, authentication, email delivery, and hosting). Those providers process limited data on our behalf under their own terms. We are not responsible for third-party services we do not control, including external badge-display platforms.
7. Intellectual property
The Service, including its software, design, and trademarks, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.
8. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we are required to do so by law. Sections that by their nature should survive termination will survive.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or in connection with your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.
11. Indemnification
You agree to indemnify and hold us harmless from any claim or demand, including reasonable attorneys' fees, made by any third party arising out of Your Content, your use of the Service, or your violation of these Terms or any law.
12. Changes to the Service or these Terms
We may modify the Service or these Terms at any time. If a change is material, we will provide reasonable notice (for example, by posting an update on this page or emailing you). Continued use after changes take effect means you accept the revised Terms.
13. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which we are established, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of that jurisdiction, unless applicable law requires otherwise.
